पोलिंग बूथों पर वोटरों की लंबी कतार की तस्वीरें एक स्वस्थ लोकतंत्र की पहचान है। परंतु बेहतर लोकतंत्र को प्रतिबिंबित करते इन दृश्यों का रोमांच तब काफूर हो जाता है जब यही कतार राशन-किराशन और पानी के टैंकरों के पीछे दूगनी होती दिखती है। एक दिनी रोमांच को पूरे पांच साल तक भुगतती आम अवाम लगातार ठगी गई है। ऐसे में प्रासंगिक है कि विकल्पों को तवज्जो मिले।

अब चूँकि केजरीवाल ने बतौर मुख्यमंत्री दिल्ली की सता संभाल ली है और उनके मंत्रियों ने सोमवार को दिल्ली की सर्द सुबह 9:15 बजे दिल्ली सचिवालय पहुँच कर अफसरशाही को स्पष्ट संकेत दे दिया है कि अब आवो- हवा बदलने वाली है। सोमवार सुबह डायरिया और तेज बुखार के कारण अरविंद सचिवालय नहीं जा सके हालांकि दिल्ली जल बोर्ड के बड़े अधिकारियों के साथ अपने घर पर एक मैराथन मीटिंग कर 5 बजते-बजते मुफ्त पानी की घोषणा कर दी गई। इस प्रकार केजरीवाल ने अपने पहले वादे को पूरा किया। परंतु जिस प्रकार पूरे दिन मीडिया और विशलेषक पंडितों ने सोशल मीडिया पर अपरिपक्वता दिखाई वह शर्मनाक है। 

इसके पहले शनिवार को शपथ लेने के साथ ही छुट्टी का दिन होने के बाबजूद केजरीवाल कैबिनेट की पहली मीटिंग हूई और वीआईपी गाडियों और लाल बत्तियों पर रोक लगाने के आदेश पारित किये गये। 

दिल्ली, एक ऐतिहासिक शहर है। एक राष्ट्रीय राजधानी है। मैट्रोपोलिटन सिटी है। इतिहास, राजनीति और आधुनिकता का अद्भुत संगम है दिल्ली। आजादी के बाद भारत की इस नगरी ने कई ऐतिहासिक मोड़ देखे है। परंतु शुरूआती दिनों से कांग्रेस ने ही यहाँ अपना आधिपत्य रखा है। हालांकि भाजपा को दिल्ली राज्य में शासन का पहला मौका 1992 में मदन लाल खुराना के रूप में मिला। परंतु 5 साल में तीन मुख्यमंत्री बदल कर विभिन्न आरोपों के बीच पार्टी ने अपनी पकड़ खो दी।

इतिहास गवाह है कि दिल्ली ने कांग्रेस और भाजपा के अलावे किसी अन्य दल को गंभीरता से नहीं लिया। अण्णा के विशुद्ध गैर-राजनैतिक आंदोलन की पृष्ठभूमि में उभरे अरविंद केजरीवाल की आम आदमी पार्टी ने जिस मजबूती से इन दो ध्रुवों को चुनौती दी है वह दिलचस्प तो है ही, एक वृहद राजनैतिक करवट की आहट भी है। दिल्ली चुनाव परिणामों में केजरीवाल की ताकत मात्र सीटों के आंकड़ों में देखना समकालीन राजनैतिक मठाधीशों की गंभीर चूक होगी। केजरीवाल सिर्फ राजनीति और चुनावों तक सीमित नहीं हैं। वे एक ऐसे शख्स के रूप में उभर चुके हैं जहाँ उन्होने भ्रष्ट राजनीतिक परिदृश्यों में एक ईमानदार एवं मजबूत विकल्प प्रस्तुत की है 

निःसंदेह ‘आप’ ने भारतीय राजनीति में नैतिक मानदंडो को इतना उँचा कर दिया है कि दिल्ली चुनावों में सबसे बड़ी पार्टी के रूप में उभरने के बावजूद भारतीय जनता पार्टी सिर्फ चार विधायकों का जुगाड़ करने से परहेज करने लगी। हालांकि केंद्र में वाजपेयी सरकार का विश्वास मत सिर्फ एक वोट से गिर जाना भाजपा के इस दावे का समर्थन करते हैं कि वह जुगाड़ में यकीन नहीं करती। परंतु झारखंड में झामुमो, यूपी में मायावती की बसपा, कर्नाटक में यदुरप्पा प्रकरण के कारण बार-बार भाजपा की छवि को नुकसान हुआ है और सता के प्रति उसके आकर्षण को भी प्रतिबिंबित करता है।

बीते 8 दिसंबर को दिल्ली चुनावों के परिणाम घोषित होने के साथ ही जो सियासी हलचल शुरू हुई थी वह थमने 
को तैयार नहीं। मीडिया में लगातार प्रश्न खड़े किये जा रहे है कि केजरीवाल ने जो लोक-लुभावन वादे जनता से किये है, वह मिथक है, अवास्तविक हैं और उन्हे जमीं पर नहीं उतारा जा सकता। मुख्यधारा मीडिया में पूरे महीने केजरीवाल के समर्थन या विरोध में खबरें चलती रही, विशेषज्ञों के पैनल उल-जूलूल काल्पनिक प्रश्नों पर तकरीर करते दिखे। 

भारत की 24*7 मीडिया केजरीवाल के पीछे 24*7 कुछ यूँ पड़ गयी कि अन्य सभी खबरें दम तोड़ती दिखी। पड़ुचेरी में 21 बर्षीय युवती के साथ क्रिसमस की रात दो बार बलात्कार, नांदेड एक्सप्रेस में 26 लोगों के जिंदा जलने, मुजफ्फरनगर में राहत कैंपों पर बुलडोजर चलाये जाने जैसी खास खबरें प्रमुखता से नही आ पाई। इन सब के बीच लगातार मीडिया ट्रायल के बाबजूद केजरीवल ने अबतक इसे अबतक खुद पर हावी नहीं होने दिया है। यह एक शुभ संकेत है और आशान्वित करता है कि आम आदमी से किये गये वादे कम से कम अपने न्यूनतम रूप में जरूर पूरे किये जायेंगे।

नीतिश ने किया सिख धर्म का अपमान, सिखों में आक्रोश

बात-बात पर मुस्लिम समुदाय की धार्मिक आस्था की प्रतीक जालीदार टोपी पहनने वाले नीतिश कुमार ने गुरूवार को पटना साहिब गुरुद्वारे में अपना सिर ढकने से साफ इनकार कर दिया, जिससे नया विवाद पैदा हो गया है। 'सेकूलर' को अपने ही परिभाषा में पिरोते नीतिश कुमार के लिए सिख समुदाय की धार्मिक भावनाओं को आहत करना आनेवाले दिनों में उनके लिए सिरदर्द साबित हो सकता है।
दरअसल, गुरुवार को नीतीश पटना सिटी स्थित प्रसिद्ध गुरुद्वारा गए थे, जहां उन्हें नए रेस्ट हाउस का उद्घाटन करना था. गुरुद्वारा कमेटी के मुताबिक, परिसर में घुसते वक्त जब नीतीश को सिर ढकने के लिए कहा गया, तो उन्होंने इससे साफ इंकार कर दिया।

इतना ही नहीं, नीतीश ने सिर न ढकने का जो बहाना बनाया, वह और भी बेतुका है। उन्होंने कहा कि उनकी तबीयत ठीक नहीं है। सीएम कुछ मिनट तक गुरुद्वारे में रुके। इस दौरान उनका सिर पूरी तरह खुला ही था। नीतीश के वहां से चले जाने के बाद गुरुद्वारा मैनेजमेंट कमेटी ने विरोध जताया। मैनेजमेंट ने कहा कि सीएम ने सिख समुदाय के प्रति असम्मान दिखाया है, जो सिख धर्म की भावनाओं से खिलवाड़ है। 

हालांकि मौके पर उपस्थित सिखों की ओर से तुरंत विरोध नहीं किये जाने को लेकर सिख अनुयायियों में काफी रोष है। कई सिख परिवारों ने इसे सिख धर्म का सार्वजनिक अपमान बताया और कहा कि कुछ चाटुकारों की वजह से नीतिश कुमार को गुरूद्धारे में प्रवेश करने दिया गया अन्यथा उनका धर्म कतई इस बात की इजाजत नहीं देता। कई संगतों ने पूरे मामले पर आनेवाले दिनों में विरोध की बात कही है। 

मालूम हो कि दो बर्ष पहले 29 दिसंबर 2011 को बाल लीला गुरूद्धारा के परिसर में 109 डीलक्स कमरे के अत्याधुनिक धर्मशाला 'राजमाता विश्वाभरा देवी यात्री निवास' का उद्घाटन हुआ था। बिहार के तत्कालीन उप-मुख्यमंत्री सुशील मोदी ने उद्धघाट्न किया था। उन्होने विधिवत सिर को ढ़कने के बाद ही गुरूद्धारा परिसर में प्रवेश किया था। और पूरे कार्यक्रम के दौरान उन्होने इसे धारण किये रखा। इसके बाद उन्होने आम जनता की तरह लंगर में अन्य अनुयायियों के साथ लंगर भी खाया था। 

हर धर्म में उसके धर्मस्थलों/पूजास्थलों के निश्चित नियम और कायदे होते हैं, जिसका पालन करना सबके लिए एकसमान जरूरी होता है। जो भी व्यक्ति इन नियमों में यकीन करता है उसे ही अंदर जाने अनुमति मिलती है। सिर्फ इस्लाम धर्म में किसी अन्य धर्म के प्रति श्रद्धा प्रतिबंधित है इसलिए इस्लाम के अनुयायी दूसरे धर्म के धार्मिक नियमों का अनुसरण नहीं कर सकते हैं। अब पता नहीं क्यूँ नीतिश कुमार इन नियमों को नियमतः व्यावहारिक जीवन में उतार रहें है? परंतु एक प्रबुद्ध नीतिश कुमार से ऐसी उम्मीद नहीं की जा सकती की उन्हें नियमों का पता न हो, और फिर यहां तो मामला अनभिज्ञता का नहीं इंकार का है।

सुशासनी बिहार की एक झलक

The Health Department is working towards providing health care “to the last household and to the last person of the state”, .i.e., Govt. Of Bihar is totally committed to building healthy people by making available quality medicare facilities on the doorstep of every citizen in the remotest corner of the state. 
These are the golden words one may come across through the every document of the Dept. Of health, government of Bihar. You may also find the similar claim on the website www.health.bih.nic.in, its official website. The state government in Bihar praises itself as an icon of 'good governance' at every next occasion. But doing the same in almost every official document seems rather cheap. At http://health.bih.nic.in/Docs/Road-Map.pdf one can get tired of the repetition of term 'susasan'. 

Anyway, there is a mammoth budget allocation for the health service sector in Bihar. For the year 2013-14 the expenditure for health sector is estimated at Rs. 3356.84 crore excluding the 410 crore for center aided schemes, adding which touches to the tune of 3766.83 crore. 

The epitome of health services in Bihar is undoubtedly none other than the Patna Medical College Hospital or PMCH. Despite this fact the situation here is horrific. Like other government hospitals, there is a great shortage of beds & other basic facilities. Even toilets, drinking water, bed and bed sheets are not available. Medicines are either not available despite the fact there is a pre-printed list of generic medicines to be prescribed by the doctors. These medicines are supposed to be in stock anytime. But the reverse is the case. The hospital mafia works here in connivance with medical representatives of various companies and hence patients get discouraged after hours of queuing-up to their turn. 

Lack of Instruments 
It is difficult to believe that in this largest hospital of Bihar, even the BP(Blood Pressure) monitoring instruments are not available in required numbers. Doctors have to wait for their turn to get them. Doctors in surgery are helpless to use corroded instruments which were bought in 1980’s. As per hospital sources(doctors), surgical scissors, trocars, dressing forceps, suture prob, bone chisel, retractor, lancet etc., all are in bad shape as they are decades old. Several requests in this regard were sent many times to the concerning authorities but all in vain. 
The doctors also lament that even after so many years, an MRI machine has not been installed in the biggest hospital in the state. This issue lingers for years and the Patna high court repeatedly gives directives from 2008 onwards. There are two things to understand. First, Is it the task of the Judiciary to run a hospital? Second, If the government fails to run a hospital how it can claim to be ‘good governance’?

The Public Private Partnership 
It would be not a surprise if this 1675-bed Patna Medical College Hospital (PMCH) will soon be handed over to private parties under the masque of PPP(Public Private Partnership) mode. The failure of governance is obvious as most of the services have handed over to run under PPP mode. But neither the opposition nor the media objected to this. 

PPP – The Doyen 

Probably, PMCH is the only government hospital in the country which houses a private diagnostic facility to take samples and mint money from poor patients. The installation of private diagnostic facility, DOYEN, in the hospital premises under the aegis of ‘susasan’ is extorting money. It charges almost 70 percent and in some case beat the market rate despite the fact that half of the expense is borne by the state. To cross verify the tall claims of ‘susasan’ that through Doyen it is providing services at half of the market price I visited various diagnostic centers. Thyrocare the world class Lab for diagnostic service charges Rs. 270 for the combined T3, T4 and TSH test. The same test by DOYEN under PPP mode charges Rs. 275 for the same. As per norms DOYEN gets Rs. 270 more from the government as well. It means Doyen is making Rs.540 for the same test which is being provided by the world class laboratory like Thyrocare at just Rs. 275. There is nothing but smell a rat. 

PPP - Ambulance Service (108) 

Similar is the case with the Ambulance-108 facility. Under the Patna municipal corporation area it charges a minimum of Rs. 300 from the patient. As per rule it gets Rs. 300 from the state as well, i.e., a total of Rs. 600 just to roam within city limits. And in most of the cases it has to run just 2-3 kms. One shocking truth the 108 ambulance call center receptionist reveals on condition of anonymity is that they(staffs) are ordered to avoid providing services to distant area as it makes them burn more fuel at the same charges(it has to cover the entire PMC area under the same charges). 

PPP- The CT Scan 
Despite several directives of the Patna high court during the last 15 years even the basic facility of CT scan could not be made available in the PMCH by the government. Though crores has been spent from the state coffer at two occaasion in the past. Ultimately, it was handed over to the PPP mode and 800 rupees being charged from the patient for the service and it is running well now. But what to those who can neither afford it at private diagnostic centres nor this PPP mode. In fact everyone but the government realizes that the PPP mode is a great scam here. Several directives of the Patna high court on the ill-equipped condition of PMCH fails to bring any changes. Earlier too and from 2008 on the court has to interfere even for the procurement of Life saving drugs in the PMCH. 

Uniform And Bed Sheet 
To protect indoor patients from infections there is a provision to provide uniform to indoor patients. The health department launched this scheme with much fanfare and about one crore rupees was spent to buy patients’ uniforms in 2012. But patients are completely unaware about such facilities. Asking to a woman attendant of a patient in the Rajendra Surgical block, whether her patient got the uniform or not, she angrily replied "we are purchasing the medicines from private shops, we had to buy a blanket that is being used as bedsheet this winter, and you are asking about the uniform"? In fact not a single indoor patient being provided the uniform (Kurta-Payjama) for more than a year due to malicious reasons. But it is not official. The dirties things about this clean uniform project is that the washing charges for these uniforms are being billed and paid despite the fact that these uniforms are not in use. This raises a question mark on the wisdom behind spending such a huge amount of public money without any monitoring. 

The ICU And The Emergency Unit 

The intensive care unit (ICU) is one of the most important unit which helps in saving the lives of critically ill patients. But, unfortunately the surgical ICU of the PMCH, emergency unit is in great shortage of beds causes over 70 per cent of the patients brought to the hospital in critical condition die. It is important to understand that most of the departments have their own ICU here. The importance of the ICU at the surgery department is most critical, keeping the high numbers of fatal road accidents and crime. Even the critical patients are left in general emergency due to lack of bed in ICU leading them for a sure death. 
Any ICU requires at least one anesthetist on 24-hour duty, because it is under his supervision all the equipments, including the ventilator, functions. Besides, at least two nurses per bed, along with several paramedical staff, are required round-the-clock. But the ICU here looks alike a garbage dump. 
The insufficient number of trolleys is another problem which makes the movement of the patients very troublesome. The condition is made worse as the paramedical staff uses these trolleys to transport medicines and bed sheets. 
Last year the then Principal secretary of Health, Govt. of Bihar, Vyas Ji remarked that the government was committed to turn the all six government medical colleges of Bihar into centers of excellence. He also expressed his satisfaction over the condition of the toilets therein. Here is the copy of the official letter in this regard released and undersigned by him. 
While the government seems busy in projecting new schemes with a mandatory page one media coverage, the officers are reluctant to act even when such reports come into light. The response time is too long even for the set rules to implement. It is natural to wonder why such reports never come in the media. 
There are various reasons, from arm twisting of media to obliging them under advertising greed. Furthermore, the hospital mafia attacked the media and cameramen in the past at many occasions while they dared to cover the menace. But to make this report foolproof I managed somehow to get my camera sneaked in the PMCH premises, ward, emergency and even toilets.

स्वच्छ राजनीति की रूमानी तस्वीर

अरविंद केजरीवाल का यह विश्वास है कि 28 सीट के साथ 'आप' अपना मनिफेस्टो लागू नहीं कर पायेगी और जब भी वह कोई विधेयक पास करना चाहेगी तो 8 विधायकों के साथ बाहरी समर्थन देती कांग्रेस उनकी सरकार गिरा देगी। कांग्रेस का ऐसा इतिहास भी रहा है, इसमें कोई दो मत नहीं है। लेकिन चूँकि दिल्ली मीडिया और राजनीति के केंद्र में है, इसलिए कांग्रेस के लिए ऐसा करना कतई आसान नहीं होगा। फिर, लोकसभा चुनावों की दहलीज पर कांग्रेस ऐसी कोई चूक नहीं करना चाहेगी जिससे उसकी छवि और बदतर हो जाये।

दिल्ली में सरकार बनाकर बतौर मुख्यमंत्री अरविंद केजरीवाल वह सब कुछ कर सकते हैं जो बाहर रह कर नहीं किया जा सकता। बतौर मुख्यमंत्री वे दिल्ली सचिवालय के उन गोपनीय दस्तावेजों तक पहुँच सकते है जो उन्हें भ्रष्ट कांग्रेसी राज-काज से रूबरू करायेगी। वे पिछले सरकारों के ऐसे संवेदनशील निर्णयों तक पहुँच पायेंगे, उनकी समीक्षा कर पायेंगे जो सता के बाहर रहकर असंभव है। जो इनपुट्स और सूत्र वे बतौर मुख्यमंत्री स्थापित कर पायेंगे वह सबकुछ बिना सता में आये संभव नही है। माना की कांग्रेस के 8 विधायकों की बाहरी मदद से चलती सरकार में इन संवेदनशील सूचनाओं के रहते केजरीवाल कुछ निर्णायक कदम नहीं ले पायेंगे। परंतु कम से कम पिछली भ्रष्ट सरकारों की लूट का रहस्य तो वे समझ ही पायेंगे।

वर्तमान परिस्थितियों में जरूरत है कि दिल्ली में ‘आप’ सरकार बनाये, सटीक सूचनाएं जुटाये, उन्हें श्रृंख्लाबद्ध करे। भ्रष्ट शासन तंत्र की कमजोर कड़ियों को पहचाना जाये। फिर सरकार का क्या है, आप जब चाहे विधानसभा भंग करवा दें। पुर्नचुनाव में जायें। जोरदार वापसी करें और इन भ्रष्ट तंत्र की चूलें हिला दें। 

राजधानी दिल्ली में देश के बेहतरीन उच्च शिक्षण संस्थान हैं। इन संस्थानों पर नामांकन का अत्यधिक दबाब है और 99 प्रतिशत की कट-आफ मार्क्स सामान्य बात हो गई है। इसी कारण जेएनयू, डीयू, जामिया जैसे दिग्गज संस्थानों के रहते दिल्ली के युवा नामांकन से वंचित रह जाते है। परंतु एक हैरत करने वाली बात यह है कि दिल्ली के कई कालेजों में सीट खाली रह जाती है, परंतु विधार्थी ही नही आते। ऐसे ज्यादातर कालेज दिल्ली सरकार के अधीन हैं। दीन दयाल उपाध्याय कालेज, सुखदेव कालेज, इंदिरा गाँधी इस्टीच्यूट समेत 12 ऐेसे उच्च शिक्षण संस्थान हैं जिसकी पूरी जिम्मेदारी दिल्ली सरकार की है, और इनमें हर सेशन में कुछ सीटें खाली रह जाती हैं। 


दरअसल, विधार्थियों के इस मिजाज के पीछे दिल्ली सरकार की अकर्मण्यता ही है। क्लासें ढंग से नहीं चलती हैं। विज्ञान के लिए प्रयोगशालायें बंद पड़ी है। दिल्ली सरकार की ओर से मिलने वाले विशेष मद Grant-In-Aid (GIA) की भारी-भरकम राशि हर बर्ष खर्च भी हो जाती है परंतु नतीजा सिफर। यूजीसी से मिलनेवाली फंड का इस्तेमाल नहीं हो पाता। बेहतर प्रशासनिक व्यवस्था कायम कर इन कालेजों की तस्वीर बदली जा सकती है। दिल्ली के गुरू तेग बहादुर विश्र्वविधालय की स्थापना 1998 में दिल्ली सरकार ने ही की थी जो काफी अच्छी स्थिति में है। फिर दिल्ली सरकार के बाकी कालेज भी जीटीबी की तर्ज पर बेहतर संचालित क्यों नहीं किये जा सकते। 'आप' यदि सरकार बनाती है तो इस मुद्दे को भी एक चुनौती के रूप में ले सकती है।

यदि स्वास्थय सेवाओं की बात करें तो दिल्ली में 40 ऐसे बड़े अस्पताल हैं जो दिल्ली सरकार चलाती है। दिल्ली कैंसर संस्थान, अंबेदकर अस्पताल तथा राजीव गाँधी सुपर स्पेशियलीटी अस्पताल इनमें से कुछ बड़े नाम है। इन चार-पांच को छोड़कर बाकी सभी की स्थिति दयनीय है। पुर्नविकास और अन्यमदों में आनेवाली धनराशि की बंदरबांट जारी है। बतौर सरकार ‘आप’ इसपर लगाम लगा सकती है। शिक्षा और स्वास्थय का सिर्फ यह दो मुद्दा व्यापक जनहित का है। ‘आप’ अपने मेनिफस्टो से दिगर इन जनहित के मुद्दों को आधार बना कर काम शुरू कर सकती है। बिजली बिल, पानी जैसे वे मुद्दे जिसपर कांग्रेस उनकी सरकार का समर्थन नहीं करे उसे टाला जा सकता है। जब 1992 में दिल्ली राज्य बनने के बाद से अबतक 22 बर्षों तक दिल्लीवासियों ने इतना कुछ झेला है तो 6 माह और सही। 

‘आप’ देश की राजनीती में स्थापित भ्रष्ट परंपराओं को तो़ड़ने की दहलीज पर है। आप ने अपने मनीफस्टो में जिक्र भी किया है कि उनका कोई भी विधायक लालबत्ती की गाड़ी नहीं लेगा, बड़ा सरकारी बंगला नहीं लेगा, भारी-भरकम सिक्योरीटी नहीं लेगा। बीते सप्ताह दिल्ली पुलिस ने अरविंद केजरीवाल को विशेष सुऱक्षा मुहैया कराने का प्रस्ताव रखा जिसे उन्होने उसी वक्त ठुकरा दिया। यह अत्यंत प्रशंसनीय और उदाहरणीय है। अगर केजरीवाल सरकार बनाते है तो ऐसे कई मौके आने निश्चित हैं जो कि कई जनप्रिय मान्यताओं को जन्म देंगे। 

कुछेक पलों के लिए फर्ज कीजिए की ‘आप’ सरकार बनाती है और केजरीवाल मुख्यमंत्री बनते हैं। मुख्यमंत्री केजरीवाल दिल्ली में आम आदमी की तरह सड़क पार करते हैं और मेट्रो से सफर करते है। सिर्फ 2-4 सादी वर्दीधारी उनके सुरक्षा में होते है। उनका मंत्रिमंड़ल डीटीसी बसों से सफर करता है। यह परिकल्पना सिर्फ एक रूमानी तस्वीर नहीं है। वर्तमान भारतीय राजनीतीक परिदृश्य में सिर्फ केजरीवाल ही वे शख्स है जो इस दृश्य को फलक से जमीं पर उतार सकते हैं। इस तरह 'आप' आगामी 6 महीने में एक ऐसा मानदंड स्थापित कर सकती है जो सिर्फ दिल्ली ही नहीं पूरे देश की सियाशी फिंजा बदल सकेगी। इन सबके लिए न तो विधानसभा में बिल पास करने होंगे और न ही कांग्रेस के 8 विधायकों पर निर्भर रहना होगा।

The Gay Law

The Section 377(Chapter XVI) of the Indian Penal Code dating back to 1861, criminalizes all sexual activities that are ‘unnatural’, including homosexual acts. The Supreme Court of India on 11 December 2013 overturned an earlier judgment of the Delhi high court that corroborates the unnatural sex between consenting adults. This apex court decision has left a trail of movement and debate in India over the relevance of such statute. 

Ours is a country where traditional social norms rooted deeply in religious and cultural beliefs . At occasions this provides a perfect pitch for clashes with individual rights. With the passage of time the sexual orientation of people has changed. It’s a worldwide phenomenon. Therefore, a law that criminalizes same- sex orientation seems obsolete. 
India is a country of varied color and hues. It homes plurality in beliefs, customs and lifestyle. The variety of laws on the basis of religion makes it more complex. The issue of sex has never been discussed in the public domain with the same openness at which it is being discussed today. Still a large section of every religion opt for a stony silence on this burning issue. Similar is the case with our political quarters which does not want to clear their stand. 

Homophobia enshrined in this statute that was written dating back to 1861. In a secular country like India religious injunctions should have no place when there be matters of legal framework. Furthermore, the lawmakers of early India, the English, were strongly influenced by the moral and religious tenets prevalent in Indian society. It was a time when the agrarian society was attached to their roots, lives among their people and enjoys the local tenets and custom. The lawmakers had to respect the scriptures and the native wisdom they conditioned to keep the social fabric not disturbed. 

It is not for nothing that this statutes came into existence. The criminality associated with homosexuality touched new heights during Mughal rules in India. The sex culture took the ugliest dimensions with surfacing of concubine, harem and encouragement of effeminating males for sexual gratification. Homosexuality with children by the rulers and their sycophants was on rise. These act was pure brutality. Male children were used as bonded laborers and sex-slaves as well by the Nizams and land owners. Penetration being the first and foremost act of sexual pleasure and since the male anatomy is not naturally fit for it, these same-sex hungry people usually rape the minors. The English introduced this law to rein such heinous crime. 

Except the sexual drive the physical and psychological characteristics involved with a gay or lesbian are not different from the rest of the society and are acceptable. In some of the most adherent religions around the globe there are scriptures to affirm this. In the land of Vatsyayana, Khajuraho and Konark, it can be no one’s case that age-old Hindu culture was inherently conservative. 
Being a Gay or Lesbian is not a matter of choice for anyone. It is a matter of sexual drive. Rejecting the reality of an offspring who is different and holding him/her hostage to social expectations by means of threat is what this Section 377 symbolizes. At present several countries have granted lesbian, gay, bisexual and transgender citizens equal rights, some even allowing them to set up families and adopt children. 

At this juncture we must volunteer to think and rethink. Drafting new laws to encompass these new dimension has now been thrust on the nation’s conscience. That’s the challenge the Supreme Court has in effect thrown at the Parliament.

फिर से राजनीती सीखें नीतिश कुमार

देश के पांच राज्यों में चुनावों और परिणाम के बाद सबकी नजरें दिल्ली पर टिकीं है। राजनीतिक पंड़ितों के बहस का मुद्दा दिल्ली में त्रिशंकु जनादेश के भविष्य को लेकर है। ऐसे में इस विषय पर मेरे विश्लेषण की कोई खास आवश्यकता नहीं है। एक गौरतलब बात जो नजरअंदाज कर दी जा रही है वह है बिहार के सतारूढ़ दल का दिल्ली में अंडरपरफारमेंस।
दिल्ली की राजनीति में नीतिश का पर्दापण 
नीतिश कुमार की जदयू ने दिल्ली विधानसभा 2013 के चुनावों में भागीदारी की है। रविवार को रिजल्ट भी आ गया। परंतु जदयू के प्रदर्शन को लेकर कोई खबर नहीं मिल पा रही थी। खैर रविवार देर रात इस संदर्भ में पुख्ता और प्रमाणित डाटा मिला। पेश है एक रिपोर्ट। 
दिल्ली विधानसभा चुनावों के रास्ते नीतिश कुमार ने दिल्ली में दस्तक दी है। चुनावों की पूर्वसंध्या पर दिल्ली की रैली में दंभ भरने वाले नीतिश कुमार को उनके उम्मीद के विपरीत परिणाम मिले हैं। 27 में से 26 सीटों पर जदयू उम्मीदवारों की जमानत जब्त हो गई है। मटियामहल से जदयू को इकलौती जीत मिली है। सबसे गौर करने वाली बात रही की मुस्लिम बहुल क्षेत्रों से जदयू प्रत्याशियों को जबर्दस्त निराशा हाथ लगी है।

अमूमन हर विधानसभा क्षेत्र में 1 लाख से 1.5 लाख वोट पड़े। जिसमें जदयू प्रत्याशियों को मात्र 100 वोट के आस-पास मिले। लक्ष्मीनगर और त्रिनगर में तो हद हो गई वहां नीतिश कुमार के प्रत्याशीयों को 91 वोट मिले। 

नीतिश कुमार ने अपनी पार्टी की ओर से दिल्ली विधानसभा के कुल 70 सीटों में 27 पर अपने उम्मीदवार खड़े किये थे। सेक्यूलर नीतिश ने यहाँ भी सेक्यूलर कार्ड खेला और लगभग आधी सीटों पर मुस्लिम उम्मीदवारों को टिकट दिये। परंतु जिस तरह से दिल्ली की जनता और मुस्लिम वोटरों ने इन्हें नकारा वह इनकी सेक्यूलर राजनीति को जबर्दस्त तमाचा है। 
साथ ही गौरतलब है कि जिन क्षेत्रों में बिहारियों की तादाद ज्यादा है वहाँ जदयू उम्मीदवारों को 100(एक सौ) वोट भी नहीं मिल सके। 
उदाहरणः- 
1. दिल्ली के लक्ष्मी नगर में अधिकांशतः लोग बिहार के हैं। कुल वोट पड़े 1,18,240 (1 लाख 18 हजार 240)। यहाँ जदयू प्रत्याशी जयराम को सिर्फ 91 वोट मिले। 
2. दिल्ली के त्रिनगर क्षेत्र में 1,03,335 (1 लाख 3 हजार 335 वोट पड़े। जदयू के सेक्यूलर राजनीति के उम्मीदवार मोहम्मद सुलेमान खान को भी मात्र 91 वोट ही मिले। 
3. मुस्लिम बहुल क्षेत्र मुस्तफाबाद में भी नीतिश के मुस्लिम उम्मीदवार चारो खाने चित गिरे। कुल वोट पड़े 1,47,082 (1 लाख 47 हजार 82). मोहम्मद शाकिब यूसूफ को मिले 164 वोट। जबकि यहाँ से कांग्रेस के एक मुस्लिम उम्मीदवार ने ही जीत दर्ज की। इसका अर्थ साफ- मुस्लिमों ने नीतिश से बेहतर कांग्रेस को समझा। 
4. मुस्लिमों की अच्छी जनसंख्या वाले क्षेत्र तुगलकाबाद से नीतिश ने मुस्लिम उम्मीदवार को खड़ा किया। इसका का सिर्फ एक ही कारण रहा होगा। परंतु जनता का निर्णय 'सेक्यूलर' राजनीति के विपरीत आया। जदयू के मोहम्मद शब्बीर को मात्र 640 वोट मिले जबकि कुल वोट पड़े 87,240। और जीत दर्ज की भाजपा के रमेश बिधूरी ने वह भी 34,000 से अधिक वोट लाकर। 

अब इतना तो तय हो गया है कि मुसलमानों को धर्म के नाम पर राजनीति में इस्तेमाल करना संभव नहीं है। अब मुस्लिम संप्रदाय भी विकास को महत्व देने लगा है। इसके साथ ही नीतिश कुमार के लिए यह खतरनाक संकेत है कि बिहार के लोग उनसे अत्यधिक नाराज है। दिल्ली के बिहारी बहुल इलाकों से बिहार के मुख्यमंत्री के अनुयायियों को 100 वोट का नहीं मिल पाना शर्मनाक है। यह संदेश है जो स्पष्ट कर रहा है कि आनेवाले आम चुनावों में नीतिश की स्थिति कांग्रेस से भी अधिक बदतर होनी तय है। इस स्थिति में नीतिश कुमार को फिर से राजनीति सीखने की जरूरत है।

मुजफ्फरपुर में नीतिश के काफिले ने निर्दोष को कुचला, व्यक्ति मरा

मुख्यमंत्री के काफिले ने कुचल कर मार डाला 

7 दिसंबर 2013 - आज मुजफ्फरपुर के पारु थाना इलाके में सीएम का काफिले एक अधिवक्ता को कुचलता हुआ आगे बढ़ गया। ताज्जुब यह की सीएम पायलट ने उसे उलटकर देखने की भी जहमत नहीं उठाई। किसी तरह स्थानीय लोगों के सहयोग से घायल को स्थानीय पीएचसी में भर्ती कराया गया। बुरी तरह कुचले जाने के कारण व्यक्ति की स्थित नाजुक होने पर उसे एसकेएमसीएच रिफर कर दिया गया। परंतु इस दौरान रास्ते में ही उसकी मौत हो गई।

अक्टूबर में भी मुख्यमंत्री काफिले ने तीन व्यक्तियों की हत्या की थी
बीते 8 अक्टूबर को सीएम काफिले ने जमुई में तीन निर्दोष व्यक्तियों को कुचल दिया था। घमंड में चूर कारकेड के अफसरों ने गति इतनी तेज कर दी थी कि 7 पुलिसकर्मी भी बुरी तरह घायल हो गये थे। 

मीडिया में नहीं आ पा रहीं ऐसी खबरें  
दरअसल, नीतिश कुमार जनविरोध से इतने डरे हुए हैं कि वे चाहते ही नहीं की उन्हें काफिले में जनता देख भी पाये और इसलिए कारकेड की स्पीड बहुत तेज कर दी गई है। भाजपा से कन्नी के बाद नीतिश कुमार को लगातार काले झंडे दिखाये जा रहे है। बीते सप्ताह तो उनके गृह जिला नालंदा में ही जनता ने उन्हे घेर लिया था। जर्बदस्त विरोध के बीच पुलिस बल को अंततः लाठीचार्ज कर सीएम को किसी तरह बाहर निकाल पाये। इसके आलावा बिहार के कांटी में पिछले महीने बहुत करीब से हवा में जूता उछाला गया था जिसे अफसरों ने हाथों हाथ कैच कर लिया... वरना खराब 'फिल्डिंग' के कारण सब सस्पेंड हो जाते। 

विरोध का आलम ऐसा भी
नीतिश कुमार के विरोध का दायरा और आवेश दोनों तेजी से बढ़ रहे हैं। बीते 13 सितंबर 2013 को पटना के रविन्द्र भवन की बिजली उस वक्त काट दी गई, जब सीएम वहाँ पहुँचने वाले थे।। इसकी खबर सीएम तक पहुँच चुकी थी पर ऐन मौके पर कार्यक्रम को रद्ध करना संभव न था। पूरे कार्यक्रम के दौरान जेनरेटर से काम हुआ। इस पूरे मुद्दे पर सीएम ने चुप रहना ही मुनासिब समझा।
